Surgical Errors

A surgical error is any preventable mistake made during surgery that results in harm to the patient. This can include wrong-site surgery, anesthesia errors, leaving surgical instruments inside the patient, or performing unnecessary surgery.

To prove negligence in a surgical error case, you need to demonstrate that the surgeon owed you a duty of care, breached that duty through an act or omission, directly caused your injury as a result of this breach, and led to damages such as additional medical bills or loss of income.

If successful, you may be entitled to compensatory damages which cover medical expenses, lost wages, pain and suffering, and sometimes punitive damages if gross negligence is proven.
